“Restorative Justice for Perpetrators of IPV: Assessing Opportunities and Challenges.”

Abstract:

Growing rates of intimate partner violence (IPV) highlight an urgent need for effective criminal legal responses. The criminal legal system has been criticized for inadequately meeting victim-survivor needs, while failing to prevent ongoing IPV perpetration, resulting in a need to explore alternatives, such as restorative justice (RJ). Drawing on interviews with 22 practitioners who work with IPV perpetrators, this study asks: To what extent is RJ suitable for cases of IPV? The findings illustrate the need to further explore factors associated with RJ implementation, including preparation for restorative practice, the accountability process for perpetrators, and community involvement in RJ. Drawing from reintegrative shaming theory, this research contributes to the understanding of factors that shape perpetrator accountability, including shame and social bonds. The findings underscore recommendations for policy and practice, such as continued development of RJ programs, along with coordinated community responses, for IPV cases.
